Terms of Service

Welcome to Elephanta.

These Terms of Service ("Terms") govern your access to and use of the Elephanta mobile application, website, and related services (collectively, the "Service") operated by Forever Lores LLC ("Forever Lores," "Elephanta," "we," "our," or "us").

By creating an account, accessing, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Elephanta.

By using the Service, you represent that:

  • You are at least 13 years old.
  • You have the legal capacity to enter into these Terms.
  • You will comply with all applicable laws.

If you are under the age of majority in your state, you may only use the Service with the involvement and consent of a parent or legal guardian.

2. What Elephanta Is

Elephanta is a private journaling and storytelling platform designed to help people preserve memories, share experiences, and strengthen relationships through guided conversations.

Elephanta is intended for personal, non-commercial use.

Elephanta is not a social network and does not publish journal content publicly.

3. Your Account

To use Elephanta, you may be required to create an account using phone-number authentication.

You are responsible for:

  • Maintaining access to your phone number.
  • Protecting access to your account.
  • Any activity that occurs under your account.

You agree not to:

  • Share accounts.
  • Impersonate another person.
  • Create accounts using false information.

4. Journal Participation

Elephanta journals are shared spaces among invited participants.

When you join a journal:

  • Other members can view messages, photos, voice recordings, and content shared within that journal.
  • Content shared in a journal may remain visible to other journal members even if you later leave the journal.
  • Journal participation is collaborative and shared among members.

You should only share information that you are comfortable sharing with other participants in that journal.

5. Ownership of Content

You retain ownership of the content you create and upload to Elephanta, including:

  • Messages
  • Stories
  • Journal responses
  • Photos
  • Voice recordings

By submitting content to the Service, you grant Forever Lores LLC a limited license to host, store, process, and display that content solely for the purpose of operating and improving the Service.

We do not claim ownership of your content.

6. Exporting Memories

Elephanta may provide tools that allow users to export journal content, including PDF memory books and similar formats.

Exported materials are generated from content provided by journal participants.

Users are responsible for how exported materials are shared, distributed, or stored after export.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any law or regulation.
  • Harass, threaten, abuse, or intimidate others.
  • Upload malicious software or harmful code.
  • Attempt to gain unauthorized access to accounts or systems.
  • Interfere with the operation of the Service.
  • Use the Service for fraudulent purposes.
  • Infringe another person's intellectual property rights.

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Privacy

Your use of Elephanta is governed by our Privacy Policy.

Please review the Privacy Policy to understand how we collect, use, and protect your information.

9. Third-Party Services

Elephanta relies on third-party service providers to operate certain features.

These providers may include:

  • Google Firebase
  • OpenAI
  • IP geolocation services

Your use of Elephanta may involve processing through these services as described in our Privacy Policy.

10. Account Deletion

You may delete your account at any time through the application or by contacting us.

When an account is deleted:

  • The account is placed into a soft-deleted archived state.
  • Personal account information is removed from active use.
  • Journal content you previously contributed may remain visible to other journal participants.
  • Archived account data may be retained for approximately three (3) years before permanent deletion, subject to legal, operational, security, or backup requirements.

11. Journal Retention

Journals belong collectively to their participants.

If a participant leaves a journal:

  • The journal remains available to remaining participants.
  • Previously shared content remains visible within that journal.

If all participants leave a journal:

  • The journal may be archived.
  • Forever Lores may permanently remove inactive archived journals after approximately one (1) year.

We reserve the right to retain backups for security, fraud prevention, legal compliance, or disaster recovery purposes.

12. Service Availability

We strive to provide a reliable Service but do not guarantee uninterrupted access.

The Service may occasionally be unavailable due to:

  • Maintenance
  • Software updates
  • Technical failures
  • Third-party service outages

We may modify, suspend, or discontinue features at any time.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOREVER LORES LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL ALWAYS BE AVAILABLE, ERROR-FREE, OR SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOREVER LORES LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO USE THE SERVICE DURING THE PREVIOUS TWELVE MONTHS, WHICHEVER IS GREATER.

15. Indemnification

You agree to defend, indemnify, and hold harmless Forever Lores LLC and its affiliates from claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any law or third-party rights.

16. Changes to These Terms

We may update these Terms from time to time.

If changes are material, we may provide notice through the Service or by other reasonable means.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
